1-1<\/strong> Sail for Boating Services is a licensed Egyptian company operating as an electronic commercial intermediary pursuant to Articles 532–537 of the Egyptian Civil Code.<\/p>\r\n 1-2<\/strong> The Application connects you with independent maritime transport and water leisure service providers. Sail is not a maritime carrier, does not own any vessel, and does not operate any trip.<\/p>\r\n 2-1 No Sail Liability:<\/strong> Sail is solely an intermediary. It bears no liability for any accidents, damage, deaths, or injuries occurring during the maritime trip. Full liability rests with the service provider alone pursuant to Egyptian Maritime Commercial Code No. 8 of 1990.<\/p>\r\n 2-2 Application Provided As-Is:<\/strong> The Application is provided without any warranties, express or implied, regarding service safety, service provider competence, vessel seaworthiness, accuracy, or reliability.<\/p>\r\n 2-3 Financial Liability Cap:<\/strong> Sail's liability to you shall not exceed the commission collected on your specific booking and shall not include consequential or indirect damages.<\/p>\r\n 2-4 No Employment Relationship:<\/strong> Service providers are fully independent contractors, not employees of Sail. Sail does not control service delivery or the service provider's operational decisions.<\/p>\r\n 2-5 Safety Is Your Responsibility:<\/strong> You accept all risks associated with maritime activities and must inform the service provider of any medical conditions. Sail does not guarantee the safety of any maritime service.<\/p>\r\n 3-1<\/strong> A booking is binding upon electronic confirmation and payment.<\/p>\r\n 3-2 Cancellation Policy:<\/strong><\/p>\r\n More than 48 hours before the trip: full refund.<\/p>\r\n<\/li>\r\n 24 to 48 hours: 50% refund.<\/p>\r\n<\/li>\r\n Less than 24 hours: no refund.<\/p>\r\n<\/li>\r\n<\/ul>\r\n 3-3<\/strong> Service provider cancellation: full refund within seven (7) business days.<\/p>\r\n 3-4<\/strong> Force Majeure: replacement booking or refund per Platform policy.<\/p>\r\n 4-1<\/strong> The user must be eighteen (18) years of age or older, or accompanied by a legal guardian.<\/p>\r\n 4-2<\/strong> The user undertakes to provide accurate data and not to use the Application for unlawful purposes.<\/p>\r\n 4-3<\/strong> The user undertakes to follow maritime safety instructions from the service provider and vessel crew.<\/p>\r\n 4-4<\/strong> Direct contact with service providers to complete bookings outside the Application is prohibited.<\/p>\r\n 5-1<\/strong> Sail undertakes to protect user data and not to disclose it except under legal obligation or with the user's consent.<\/p>\r\n 5-2<\/strong> By accepting these Terms, you agree to the collection of your data for service operation and Application improvement.<\/p>\r\n 5-3<\/strong> Sail reserves the right to share data necessary for booking completion with service providers only.<\/p>\r\n 6-1<\/strong> The Parties commit to settling all disputes amicably prior to resorting to litigation, and the courts of New Cairo shall have jurisdiction over any legal disputes.<\/p>\r\n 7-1<\/strong> Sail reserves the right to amend these Terms, notifying users at least fourteen (14) days before amendments take effect.<\/p>\r\n 7-2<\/strong> Continued use of the Application after an amendment notice constitutes automatic acceptance of the updated Terms.<\/p>\r\n 7-3<\/strong> Sail may suspend or delete any account that violates these Terms immediately and without prior notice.<\/p>\r\n By downloading the Application, registering an account, or completing any booking, I confirm that I have fully read, understood, and voluntarily agreed to these Terms & Conditions, and that I alone bear responsibility for decisions based on use of this Application.<\/p>","type":"privacy_policy"}}2.
